Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Learning Management System (LMS) website operated by Truth Theology Academy (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

Service/LMS: Refers to the Truth Theology Academy website and all related applications, software, tools, and platforms provided for educational content delivery.
User/Student: Any individual who registers, enrolls, or accesses the Service, whether paid or unpaid.
Content: Includes all courses, videos, audio, text, graphics, files, data, and other materials available on the Service.

2. Accounts and Registration

Account Creation: To access courses on the LMS, you must register for an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.
Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Age Restriction: Users must be at least 18 years of age to register for the Service. If a user is under the age of 18, a parent or guardian must create the account and supervise the child’s use.

3. Intellectual Property Rights

Content Ownership: The Service and its original Content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Truth Theology Academy and its licensors. The Content is protected by copyright, trademark, and other laws of South Africa and foreign countries.
Limited License: Upon enrollment, you are granted a limited, non-exclusive, non-transferable license to access and view the course Content for which you have paid all required fees, solely for your personal, non-commercial educational purposes.
Prohibited Actions: You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, or otherwise transfer or use any Content unless we give you explicit permission to do so in a written agreement signed by a Truth Theology Academy authorized representative.

4. User Conduct and Prohibitions

You agree not to use the Service in any way that:

Violates any local, provincial, national, or international law or regulation.
Infringes on the rights of others, including copyright, privacy, or intellectual property rights.
Involves the submission of harassing, defamatory, abusive, or hateful content.
Attempts to interfere with the proper working of the Service, including introducing viruses, Trojans, worms, or other harmful materials.
Involves “scraping” or other automated means of accessing the Content or data.

Truth Theology Academy reserves the right to terminate your account and access to the Service immediately, without prior notice or liability, if you breach these conduct rules.

5. Fees and Payment

Pricing: Course fees are listed on the website and are subject to change without notice. Any price changes will not affect courses you have already purchased.
Payment: All payments must be made in the currency specified (e.g., South African Rand (ZAR)). You agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees.
Taxes: All stated prices are inclusive of any applicable taxes (e.g., VAT), unless otherwise stated.

6. Cancellation and Refund Policy

Your enrollment and access to the courses are subject to the following cancellation and refund terms:

A. Course Enrollment Cancellation (By User)

Self-Paced/On-Demand Courses: Since access to the course materials is granted immediately upon enrollment, cancellation is treated as a request for a refund, subject to the conditions in Section 6.B.
Live/Scheduled Courses: If a course has fixed start dates and live components, you may cancel your enrollment before the start date.
- Cancellation more than 7 days before start: 100% refund of course fees paid, minus a small administrative fee (e.g., 5% or ZAR [Insert Amount]).
- Cancellation 7 days or less before start: 50% refund of course fees paid.
- Cancellation on or after the start date: No refund will be granted.

B. Refund Policy (On-Demand and Self-Paced Courses)

We offer a limited refund window for self-paced courses, recognizing the immediate access to Content.

Time Limit: A request for a refund must be submitted via email to school@truththeologyacademy.co.za within 14 days of the date of purchase.
Access Limit: To qualify for a refund, the Student must not have completed more than 10% of the course Content (measured by video watch time, assignment submission, or quiz completion). If you have downloaded any significant portion of the course Content, your refund request may be denied.
Non-Refundable Items:
- Fees for courses purchased outside the 14-day window.
- Fees for courses where over 10% of the Content has been consumed.
- Administrative, processing, or third-party payment gateway fees.
Processing: Approved refunds will be processed within 30 business days and will be returned via the original method of payment, or another method as agreed upon. The refund is minus all bank and transaction fees at 2.8% (2.8 percent)

C. Course Cancellation (By Truth Theology Academy)

Truth Theology Academy reserves the right to cancel or reschedule a course (especially live/scheduled courses) due to insufficient enrollment, instructor illness, or other unforeseen circumstances. If we cancel a course you have paid for:

You will be offered the option to transfer your enrollment to the next available session of the same course.
Alternatively, you will receive a 100% full refund of the course fee paid, with no deductions.

7. Disclaimers and Limitation of Liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Truth Theology Academy makes no guarantees regarding the outcome of completing any course. We do not warrant that:

The Service will function uninterrupted, secure, or available at any particular time or location.
Any errors or defects will be corrected.
The Content is free of viruses or other harmful components.

To the maximum extent permitted by applicable law, in no event shall Truth Theology Academy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any Content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or Content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of The Republic of South Africa, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
